A paralegal can work as a fee-for-service advocate to represent clients in Provinvial Offences(traffic) Court, Small Claims Court or before an Administrative Board (e.g. the Landlord and Tenant Board) Paralegals may also work as part of a legal team supporting Lawyers who deal with more complex issues and cases.
Our Paralegal, Jessica Schnakenberg, will be working out of our New Liskeard, Englehart and Kirkland Lake Offices. She will be specifically working in the areas of:
Traffic Court
Traffic Court is a branch of Provincial Offences including speeding, careless driving, parking tickets and highway traffic offences.
Small Claims
Small Claims Court hears any action for the payment of money or the recovery of possession of property where the amount of the claim does not exceed $25, 000, excluding interest and costs, such as court fees. Work in this area includes court representation such as drafting and filing claims, defences or defendant’s claims, attendance at pre-trial/ settlement conference, and preparation and attendance on motions and trials.
Provincial Offences
Provincial Offences are non-criminal charges, primarily laid by the police. Jessica will be working in the areas of the Liquor Licence Act, Fire Protection and Prevention Act, and City By-Laws.
Residential Tenancy - on behalf of the landlord
The Landlord and Tenant Board deals with matters under the Residential Tenancies Act, 2006. In this area Jessica will strictly be working for the landlord drafting forms, serving documents, and representation at hearings.
Ministry of Labour work will include the preparation, drafting of documents and representation of the employer in matters relating to the Labour Relations Act, Occupational Health & Safety, etc.
CPP
If you have paid CPP premiums and have become disabled or are not competitively employable, you may be entitled to disability benefits. Work in this area will be aiding in the appeal process.
